§ 340.110. All-Terrain Vehicles, Utility Vehicles, And Golf Carts On City Streets.

  • A. 
    Definition. As used in this Section, the following terms shall have the following definitions:
    GOLF CART
    Any motorized vehicle powered electrically or by any other means designed and manufactured for operation on a golf course for sporting and recreational purposes.
    B. 
    No person shall operate an all-terrain vehicle, a utility vehicle, or a golf cart upon the streets of this City:
    1. 
    Except under the requirements established herein. Governmental agents operating such vehicle for official use are exempt from these requirements.
    2. 
    Without maintaining proof of financial responsibility or any other insurance policy providing equivalent liability coverage.
    3. 
    Without first obtaining an informal safety inspection performed by a member of the Owensville Police Department.
    4. 
    Without first obtaining a permit from the City. The annual administrative fee for such a permit shall be fifteen dollars ($15.00). The permit shall be valid for one (1) year.
    5. 
    Without being in possession of a valid, State-issued motor vehicle operator's license but shall not be required to have passed an examination for the operation of a motorcycle.
    6. 
    In violation of any posted speed limit or traffic control signal
    7. 
    In violation of any laws or ordinances regarding the safe operation of a vehicle on City streets. This shall include, but not be limited to, the use of seatbelts, child safety seats, and turn signals.
    8. 
    In excess of twenty five (25) miles per hour.
    9. 
    In any careless way so as to endanger the person or property of another.
    10. 
    While under the influence of alcohol or any controlled substance.
    11. 
    Earlier than sunrise or later than sunset on the day of operation.
    C. 
    No person shall operate an all-terrain vehicle, a utility vehicle, or a golf cart upon any County or State maintained highway within the City Limits except to cross said highway from one City street to another City street. Nothing herein shall be interpreted as prohibiting the lawful use of a recreational off-highway vehicle (as defined by Section 301.010, RSMo.) in accordance with Section 304.033, RSMo.
    D. 
    No person shall operate, ride, be towed by, or be otherwise propelled by an all-terrain vehicle without a securely fastened safety helmet on his or her head unless the person is at least eighteen (18) years of age.
    E. 
    No person operating an all-terrain vehicle, a utility vehicle, or a golf cart shall carry more passengers than said vehicle is designed to carry.
    F. 
    Every all-terrain vehicle, utility vehicle, and golf cart operated on City streets shall have the following equipment:
    1. 
    An equilateral triangular emblem mounted on the rear of such vehicle at least two (2) feet above the roadway. The emblem shall be constructed of substantial material with a fluorescent yellow/orange finish and a reflective red border at least one (1) inch in width. Each side of the emblem shall measure at least ten (10) inches;
    2. 
    A bicycle safety flag attached to the rear of the vehicle which shall extend not less than seven (7) feet above the ground;
    3. 
    Adequate brakes, safe tires, and reliable steering.
    G. 
    No person shall operate an all-terrain vehicle, a utility vehicle, or a golf cart within any stream or river in this City, except that said vehicles may be operated within waterways which flow within the boundaries of land which are owned by an operator of said vehicle or for agricultural purposes within the boundaries of land which an operator owns or has permission to be upon, or for the purpose of fording such stream or river of this State at such road crossings as are customary or part of the highway system.
